An asylee is an individual seeking protection while physically in the US, whereas a refugee is an individual seeking protection while physically outside of the US. In order to qualify for the status as an asylee or refugee, the person must demonstrate that (s)he is “unable or unwilling to return to, and is unable or unwilling to avail himself or herself to the protection of that country because of persecution or a well-founded fear of persecution on account of race, religion, nationality, membership in a particular social group or political opinion.”
